Disney+ ‘Knock-off’ side likely to sue for huge penalties
This has led to speculation that Disney+ could be facing a hefty penalty lawsuit.
When celebrities sign contracts for commercials, dramas, movies, etc., they usually include a “duty of decency clause” that requires them to pay a penalty if they cause social harm. This is because their image is directly linked to their work and brand value.
The production cost of “Knock-Off” is 60 billion won (~41M USD). The lead actor’s appearance fee is set at 10 to 20 percent of the production cost. It is estimated that Kim Soohyun’s appearance fee is between 500 and 800 million won per episode for 8 episodes (~344K – 555K USD), which is more than 5 billion won for the eight episodes (~3.4M USD).
If Disney+ sues for a hefty penalty, Kim could be liable not only for the guarantee, but also for damages caused by production delays and canceled episodes.
Considering that actors typically seek damages of 20 to 30 percent of production costs when they breach their contracts, Disney+ could be looking at tens of billions of won in penalties.
Global OTT company sues…Hollywood actor ‘on the verge of bankruptcy’
In fact, Hollywood actor Kevin Spacey is reportedly on the verge of bankruptcy after paying a penalty to Netflix.
Kevin Spacey was removed from the Netflix original series House of Cards in 2018 after he was caught up in a same-s*x scandal.
At the time, Netflix sued Kevin Spacey for 30 million USD in damages. A U.S. court ruled in favor of Netflix, and Kevin Spacey was forced to sell his property to pay the hefty penalty.
In 2018, he told a British television program, “I sold my current home. I’m on the verge of bankruptcy because of the legal fees and huge penalties for the g*y s*x scandal.”
“Disney+ is considered a global OTT company just like Netflix,” said an industry insider, “and if an actor’s personal life causes damage, they are likely to be held legally responsible. Kim Soohyun’s response will be an important variable.”
